Member States to facilitate broadband investment

Have any measures to streamline planning or administrative procedures been introduced to improve broadband investment conditions? Yes The Electronic Communications Act includes many provisions that facilitate investing. Most of these provisions and/or measures are taken from the EU regulative framework like authorisations streamlining, stimulation of shared use of properties and capacities, interconnections and operators sharing access; there are also many provisions regarding the provision of competition and right of way. Some provisions are nationally specific like obligatory common use of free capacities from other types of public trading infrastructure, declaring the construction of public communication networks and associated infrastructure to be a public benefit, obligation to enter data on public communication networks into the register of infrastructural networks; for the requirements of the land use the act includes a provision stating that the cable ducts shall be considered public trading infrastructure. The system of cable duct built in this way must be available to all interested operator under the same terms and conditions. Local communities shall within the frame of their power promote the construction of public communication networks. They mainly make easement and other agreements with operators to use their community infrastructure, inform operators about planned further interventions in their existing infrastructure and may plan the construction of open BB networks.

Has the digital dividend spectrum (790 - 862MHz) been repurposed for mobile broadband and assigned to operators? No The digital dividend spectrum has been assigned to network operators and/or secondary trading of the spectrum has been enabled and/or licences for the digital dividend spectrum stipulate minimum geographical coverage obligations.
